GAO’s Annual Bid Protest Report:  Protest Filings and Sustain Rate Soar

On Thursday, GAO released its Bid Protest Annual Report to Congress for Fiscal Year 2023 , which provides bid protest statistics and other interesting information regarding GAO’s protest system. The sustain rate increased from 13% to 31%. For each of the past four years, the sustain rate has alternated between 13% and 15%.

2,025 protests were filed in FY 2023, representing a 22% increase from the previous year. Increase in the sustain rate. In FY 2023, the sustain rate increased to 31%. From 2019 to 2022, the sustain rate hovered around 13-15%. Without the 119 sustains, the sustain rate would remain at about 14%.
