Yesterday I looked into the main text of the draft Council of Ministers Resolution introducing mandatory green publicprocurement in Portugal. The criteria or contract-related critiques will come on Monday and hopefully, Tuesday. I had assumed that looking into it would be a two part affair.
The Portuguese government is planning to introduce mandatory green publicprocurementcriteria in the near future. This means the public sector in Portugal will have less than 3 months to adapt to a fairly significant change in the way it carries out publicprocurement.
After parts I , II and III we finally reach part IV on the purchase or leasing of vehicles (contract type - 5) For these, the Annex establishes four different awardcriteria and two contract performance clauses/technical specifications, with issues to be found on both, mostly due to the non-technology neutral approach to the drafting.
After the first two entries ( here and here ) of a more general nature, this one will be focused on contract specific critiques, in particular food procurement (contract types 9 and 15). Is it of the contract value? Not even being a recommended contract performance clause or technical specifications saves this one.
The achievement Kazakhstan has seen a dramatic decline in the use of single-source procurement in recent years. In Part 1 of our FAQs for suppliers , we covered key changes to the procurement process and what suppliers can do to get ready for the Procurement Act. The list will be managed by the Procurement Review Unit (PRU) and will contain the names of excluded and excludable suppliers. How will the exclusion and debarment regime work?

In the UK, publicprocurement is essential to providing high-quality public services. Companies wishing to work with public sector organisations must know who the key players in publicprocurement are. These contracting authorities handle high value defence contracts and work with strategic suppliers.
Challenge: Despite ongoing government reforms, corruption and inefficient spending remains pervasive in Kazakhstan’s publicprocurement. Kazakhstan has radically reformed legislation governing general publicprocurement, one of the highest risk sectors, but enforcement has been mixed.
The email argued that the maintenance shed which is part of the contract object would be used for the manufacturing of the trains and as such constitute illegal state aid. A couple of caveats here though: I'm a lot less comfortable discussing state aid than I am publicprocurement since my expertise is in the latter.
Challenge : In 2020, only 5% of Lithuania’s publicprocurement spending by value used green criteria that favor environmentally friendly products and services. Results : Levels of green procurement uptake across Lithuanian public institutions have increased to 94% by value and 93% by total procedures as of 1 December 2023.
The National Procurement Policy Statement this month applies to all contracting authorities who are subject to the procurement rules. Whilst broadly welcomed it raises a number of practical challenges for local authorities and the wider public sector. What Does the National Procurement Policy Statement Say?
In its Judgment of 4 October 2012 in case C‑629/11 P Evropaïki Dynamiki v Commission (ESP-ISEP) , the Court of Justice has issued another interesting decision on what should be considered sufficient debriefing of disappointed bidders in publicprocurement procedures. 1) (‘the Financial Regulation’).
It was announced yesterday that the Portuguese train company (CP) chose a consortium headed by Alstom as the preferred bidder for its first major train procurementcontract in many decades. The procurement procedure was launched in December 2021 and adopted a MEAT approach for the awardcriteria.
Can public authorities procure fair trade products, or are they debarred from specifically referring to the fair trade qualities of those products under the publicprocurement directive (directive 2004/18/EC)? Technical specifications or contract performance conditions? Netherlands.
I continue exploring the use of publicprocurement as a tool of digital regulation (or ‘AI regulation by contract’ as shorthand)—ie as a mechanism to promote transparency, explainability, cyber security, ethical and legal compliance leading to trustworthiness, etc in the adoption of digital technologies by the public sector.
In this post as part of our series exploring the impact of AI on publicprocurement , we’ll outline our approach and lessons learned. But the EU’s procurement notices use the Common Procurement Vocabulary (CPV), not these product groups, so we had to match the product groups to CPV codes (see our spreadsheet ).
