The 2020 European strategy for data ear-marked public procurement as a high priority area for the development of common European data spaces for public administrations. In many cases, the data quality needs to be improved. The procurement data governance framework is now planned to be developed in the second half of 2023.
E-procurement platforms and data analytics tools can provide greater visibility into public sector procurement opportunities, making it easier for suppliers to identify contracts suited to their capabilities. Another emerging trend is the increasing use of digital marketplaces.
Similar issues arise with the possibility to creatively structure remuneration under some of these contracts to keep them below regulatory thresholds (eg by ‘remunerating in data’). Award criteria could generate (further) incentives for regulatory performance, perhaps beyond the minimum mandatory baseline.
