On February 13, Nick Ephgrave QPM gave his first public speech as Director of the United Kingdom Serious Fraud Office (SFO), during which he expressed a desire to pay awards to financial fraud whistleblowers in the U.K. “I think we should pay whistleblowers,” said Ephgrave. The SFO and Financial Conduct Authority (FCA) have historically been resistant to the idea of whistleblower awards.

Traditionally, investor-state dispute settlement (“ ISDS ”) has not been linked to Environmental, Social, or Governance principles (“ ESG ”). At least not explicitly. Acceleration is increasingly on the agenda for construction projects. Its use for decades in the United States in the form of constructive acceleration appears to continue unabated, and there is some evidence that the concept may be sought to be applied more broadly in other jurisdictions, including in the international marketplace through alternative dispute resolution mechanisms such as mediation, expert determination, adjudication, and arbitration.
